When is it okay to withhold rent? Almost never.
Tenants often withhold rent because they have made repairs to the property. It is the landlord’s duty to repair the property, not yours. But, a landlord cannot make repairs he or she does not know about. So, the first thing you should do is notify the landlord in writing that you need something repaired. If he or she refuses to make the repair, it is still not okay to withhold rent. There are very specific rules about when it is okay to withhold rent and the landlord should agree to it. By withholding rent, you may not only weaken your legal claim, but you may give the landlord a basis to evict you.
